Costs & Fees Policy

At ABS&P, we believe in transparency, predictability, and fairness in our billing practices.

Our standard delivery model is based on unbundled (limited-scope) legal services, which allows clients to retain control over their matter while receiving high-quality professional advice and support at a controlled cost.

Our Fee Structure

  • We primarily offer legal advice, strategic guidance, drafting, negotiation support, litigation support, and alternative dispute resolution (ADR) services.

  • Under our unbundled model, clients – with our guidance – remain responsible for filing documents with courts or tribunals unless otherwise agreed. We believe this is a good thing as it enables clients to be fully involved in their matter.

  • Court appearances and oral advocacy (if required) are charged separately and are not included in standard advisory packages.

  • All third-party expenses and disbursements (court fees, counsel fees, expert reports, travel, etc.) are passed on at cost and are additional to our professional fees.

Capped (Fixed) Fee Arrangements

At the start of every engagement, we will discuss the anticipated scope of work and propose a capped (fixed) fee geared up to the matter. This capped fee is agreed in writing and is calculated based on:

  • The estimated time and complexity of the tasks involved

  • The seniority and expertise of the personnel assigned.

The capped fee represents the client’s purchase of a reserved block of professional time dedicated exclusively to their matter. Once purchased, this time is reserved for the client regardless of whether it is ultimately used.

Important points about capped fees:

  • The capped fee is not a retainer and is non-refundable, even if the matter resolves early or less time is ultimately required.

  • We reserve the right to review and, if necessary, increase the capped fee (with the client’s prior agreement) if:

    • The scope of work materially changes

    • Unexpected complexity arises, or

    • Additional work is instructed by the client

  • Any variation to the capped fee will be discussed openly and confirmed in writing before additional costs are incurred.

Client Funds

We do not hold client money in a client account except where strictly required by law or court order. All disbursements are paid directly by the client or invoiced and reimbursed at cost.
